Terms of Service

Welcome to Equilibrio! These Terms of Service ("Terms") govern your use of the Equilibrio mobile application and related services (the "Service"). By using Equilibrio, you agree to these Terms.

1. Acceptance of Terms

By creating an account or using Equilibrio, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the Service.

You acknowledge that these Terms are between you and Equilibrio only, and not with Apple, Inc., Google LLC, or any other third party. Equilibrio, not Apple or Google, is solely responsible for the Service and the content thereof.

2. Description of Service

Equilibrio is a study and wellness management application that provides:

• Study session timers (Pomodoro and Flowtime modes)
• Guided break activities (breathing exercises, stretches)
• Mood and energy tracking
• Deadline and exam management
• Calendar synchronization
• Study statistics and analytics

3. Account Registration

• You must be at least 13 years old to use Equilibrio
• You must provide accurate and complete registration information
• You are responsible for maintaining the security of your account credentials
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account

4. Subscription & Payment

Free Tier

The free tier includes:

• Unlimited Pomodoro timer sessions
• One breathing exercise and one stretch routine
• 7-day study statistics
• Up to 5 active deadlines

Premium Subscription

Equilibrio Premium ($4.99/month or $49.99/year, or as otherwise stated in the app) includes:

• Flowtime mode - study without time limits
• Unlimited deadlines
• Recurring deadlines - auto-regenerating tasks
• Smart Scheduler - AI-powered study planning
• Study Slot Heatmap - visualize your availability
• Calendar sync - sync deadlines to your device calendar
• Full analytics and statistics history
• Premium break activities - stretches, brain games, and mindfulness exercises

Billing

• Subscriptions are billed through the Apple App Store or Google Play Store
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• You can manage or cancel your subscription through your device's app store settings
• Refunds are handled according to the respective app store's refund policies

Auto-Renewal Disclosure

For Apple App Store: Payment will be charged to your iTunes Account at confirmation of purchase. The subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the cost of the chosen plan. You can manage or turn off auto-renew in your Apple ID Account Settings any time after purchase.

For Google Play: Payment will be charged to your Google Play account at confirmation of purchase. The subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period. You can manage or turn off auto-renew in your Google Play Store account settings any time after purchase.

5. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service
• Reverse engineer, decompile, or disassemble the application
• Create multiple accounts to abuse free tier limitations
• Share your account credentials with others
• Use automated systems or bots to access the Service

6. Intellectual Property

Equilibrio and its original content, features, and functionality are owned by Equilibrio and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our express written permission.

7. User Data

• You retain ownership of the data you create in Equilibrio (study sessions, deadlines, etc.)
• We have the right to use anonymized, aggregated data to improve our services
• See our Privacy Policy for details on how we handle your data

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• The results obtained from the Service will be accurate or reliable
• Any errors in the Service will be corrected

Maintenance and Support

Equilibrio is solely responsible for providing any maintenance and support services for the App. You acknowledge that Apple, Google, and other platform providers have no obligation whatsoever to furnish any maintenance and support services with respect to the App.

In the event of any failure of the App to conform to any applicable warranty, you may notify Apple or Google (as applicable), and they will refund the purchase price for the App (if any); to the maximum extent permitted by applicable law, Apple, Google, and other platform providers will have no other warranty obligation whatsoever with respect to the App.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EQUILIBRIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

10. Health & Wellness Disclaimer

Equilibrio is designed to help with study management and general wellness. It is not a substitute for professional medical, psychological, or educational advice. If you have concerns about stress, anxiety, or academic performance, please consult appropriate professionals.

11. Termination

• You may terminate your account at any time by deleting your account through the app or contacting us
• We may suspend or terminate your account if you violate these Terms
• Upon termination, your right to use the Service will immediately cease
• Provisions that by their nature should survive termination will survive

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the app or through other communication methods. Your continued use of the Service after such changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

14. Legal Compliance

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
